Who decides your IR35 status
IR35 is the set of rules that decides whether a contractor is taxed like an employee. If your client is a medium or large business, or any public sector body, the client decides and must give you a status determination statement explaining why. If you disagree, you can challenge it, and the client has 45 days to respond.
For a small private sector client, your own company makes the decision instead. When a contract is inside IR35, the fee payer, usually the agency, deducts tax and National Insurance before paying your company. That income is not taxed again when it is passed on to you, provided it is recorded correctly.
